Welcome to Maya Continental Company. These Terms and Conditions (“Agreement”) govern all products, services, rentals, installations, technical support, consulting, website usage, estimates, invoices, online payments, and transactions provided by Maya Continental Company and
its registered DBA entities, including:

  • MAYA SECURITY SERVICES
  • MAYA DIGITAL DESIGN
  • MAYA POINT OF SALE 
 
By requesting services, approving estimates, paying deposits, making payments, signing agreements, using our website, or accepting delivery of products or services, the customer (“Client,” “Customer,” or “User”) agrees to all terms contained herein.

Maya Continental Company sells, installs, services, rents, supports, configures, consults, and integrates commercial technology solutions including but not limited to:

  • Merchant Processing Services

  • Business Phone Services (VoIP)

  • Commercial Sound Systems

  • Networking & Structured Cabling

  • Commercial TVs

  • Digital Menu Boards

  • Digital Signage

  • Business Electronics Hardware

  • Technical Support Services

  • Website Development

  • SEO Services

  • Advertising & Marketing Services

  • Social Media Management

  • Graphic Design

  • Branding Services

  • Printing Services

  • Food Photography & Video Production

  • Equipment Rentals including POS Systems, Kiosks, Printers, and Hardware

All products and services are provided subject to these Terms and Conditions.

3. Estimates, Deposits, and Payment Terms

3.1 Estimates & Quotes

All estimates, proposals, and quotations are non-binding until approved by the Company.

Prices are subject to change due to:

  • Supplier pricing changes

  • Tariffs

  • Availability

  • Shipping increases

  • Market fluctuations

  • Project scope changes

3.2 Deposits

A minimum deposit of fifty percent (50%) may be required before:

  • Scheduling

  • Ordering equipment

  • Beginning work

  • Reserving rental equipment

Deposits may be non-refundable once equipment has been ordered, configured, programmed, or processed.

3.3 Payment Due

All invoices are due immediately upon completion of work, delivery of equipment, or activation of services unless otherwise agreed in writing.

3.4 Electronic Payment Processing Fee

A service fee of up to three percent (3%) may be applied to electronic payments including:

  • Credit cards

  • Debit cards

  • ACH

  • Online payment methods

This fee is waived for payments made by cash or check where permitted by Illinois law.

3.5 Late Payments

Late balances may accrue interest at a rate of twenty percent (20%) annually or the maximum rate permitted under Illinois law, whichever is lower.

The Client agrees to pay:

  • Collection costs

  • Attorney fees

  • Court costs

  • Recovery expenses

related to unpaid balances.

4. Returns, Refunds, and Cancellations

4.1 Eligible Returns

Eligible electronic products may be returned within fourteen (14) calendar days only if:

  • Authorized by the Company

  • In original condition

  • In original packaging

  • Not installed

  • Not damaged

  • Not programmed or customized

4.2 Non-Returnable Items

The following are strictly non-refundable and non-returnable:

  • Installed systems

  • Security camera systems after installation

  • Customized systems

  • Special orders

  • Opened software

  • Programmed equipment

  • Digital services

  • Marketing services

  • Design services

  • Subscription services

  • Labor charges

  • Merchant service fees

4.3 Cancellation Fees

Orders canceled after processing or after deposit payment are subject to:

  • Twenty percent (20%) restocking fee

  • Shipping charges

  • Handling charges

  • Labor charges already incurred

5. Rental Equipment Terms

All rental equipment remains property of Maya Continental Company.

Clients renting equipment agree to:

  • Maintain equipment in proper condition

  • Use equipment lawfully

  • Return equipment on time

  • Protect equipment from theft, damage, abuse, or misuse

The Client is fully responsible for:

  • Loss

  • Theft

  • Damage

  • Repair costs

  • Replacement costs

  • Insurance coverage

Late returns may incur additional daily rental fees.

The Company may charge any card or ACH account on file for:

  • Unpaid rental fees

  • Damages

  • Missing equipment

  • Recovery costs

6. Surveillance, Security Camera & Recording Disclaimer

6.1 No Guarantee of Performance

Security systems, cameras, recording devices, networks, and related technology may fail due to:

  • Internet outages

  • Power failures

  • Hardware failure

  • Software failure

  • Environmental conditions

  • Storage limitations

  • User error

  • Cybersecurity incidents

The Company does not guarantee:

  • Continuous recording

  • Recording retention

  • Event capture

  • Prevention of theft or criminal activity

  • Admissibility of recordings in legal proceedings

6.2 Client Responsibility

The Client is solely responsible for:

  • Compliance with surveillance laws

  • Consent requirements

  • Audio recording laws

  • Monitoring regulations

  • Data retention requirements

6.3 Evidence & Video Footage

Maya Continental Company:

  • Does not store client evidence

  • Does not archive footage

  • Does not maintain copies of downloaded recordings

  • Does not provide cloud storage unless specifically contracted

  • Does not erase evidence intentionally

  • Does not advise clients to delete evidence

  • Does not review downloaded footage unless specifically requested by the client

When assisting with footage exports, the Company only exports footage based on:

  • Date

  • Time

  • Camera number

  • Client instruction

Footage may be delivered by:

  • USB drive

  • Download link

  • Email

  • Text message

without retaining copies.

6.4 Automatic Overwrite Notice

Clients acknowledge surveillance storage systems commonly overwrite prior recordings automatically once storage capacity is reached unless separate backup systems are installed by the client.

The Company is not responsible for overwritten, erased, corrupted, inaccessible, or unavailable recordings.

6.5 No Liability for Criminal Activity

The Company is not responsible for:

  • Theft

  • Vandalism

  • Assault

  • Property loss

  • Criminal acts

  • Employee misconduct

  • Missed recordings

even if systems were installed, serviced, monitored, or configured by the Company.

7. Merchant Services Disclaimer

Merchant services are provided through third-party financial institutions and processors.

The Company does not guarantee:

  • Approval

  • Processing rates

  • Service availability

  • Funding timelines

The Client remains solely responsible for:

  • Chargebacks

  • PCI compliance

  • Dual pricing compliance

  • Cash discount programs

  • Surcharge compliance

  • Tax compliance

The Company is not liable for:

  • Processor outages

  • Held funds

  • Frozen accounts

  • Chargebacks

  • Processor terminations

8. Website, SEO, Marketing & Advertising Services

The Company does not guarantee:

  • SEO rankings

  • Advertising performance

  • Sales increases

  • Social media growth

  • Search engine placement

  • Lead generation results

Clients are solely responsible for:

  • Content legality

  • Copyright compliance

  • Trademark compliance

  • Advertising claims

  • Regulatory compliance

The Company is not liable for:

  • Platform suspensions

  • Social media bans

  • Advertising rejections

  • Third-party policy changes

9. Technical Support & Remote Access

Remote support may be provided using third-party software including TeamViewer or similar tools.

The Client authorizes remote access upon requesting support.

The Company is not liable for:

  • Data loss

  • Corrupted systems

  • Third-party software conflicts

  • Malware

  • Viruses

  • Security breaches

  • Network failures

The Client is solely responsible for maintaining backups of:

  • Files

  • Databases

  • POS data

  • Surveillance recordings

  • Websites

  • Customer records

10. Cybersecurity Disclaimer

No network, surveillance system, POS system, website, or technology service can be guaranteed completely secure.

The Company disclaims liability for:

  • Hacking

  • Ransomware

  • Data breaches

  • Malware

  • Unauthorized access

  • Cyberattacks

  • Credential theft

Clients are responsible for:

  • Password security

  • Antivirus protection

  • Firewall management

  • Security updates

  • User permissions

11. Limitation of Liability

To the fullest extent permitted under Illinois law:

The total liability of Maya Continental Company, its owners, officers, employees, contractors, technicians, installers, affiliates, and representatives shall not exceed the total amount paid by the Client for the specific product or service giving rise to the claim.

The Company shall not be liable for:

  • Indirect damages

  • Consequential damages

  • Incidental damages

  • Punitive damages

  • Lost profits

  • Business interruption

  • Data loss

  • Reputation damage

12. Employee, Contractor & Affiliate Protection

No owner, employee, technician, installer, contractor, affiliate, or representative of Maya Continental Company shall be held personally liable for claims arising from services or products provided by the Company.

All protections, disclaimers, and limitations within this Agreement extend to:

  • Employees

  • Contractors

  • Installers

  • Technicians

  • Affiliates

  • Subcontractors

13. Arbitration & Legal Disputes

13.1 Mandatory Arbitration

Any dispute arising from services, products, invoices, agreements, or transactions shall be resolved exclusively through binding arbitration in the State of Illinois.

The Client waives:

  • Jury trials

  • Class actions

  • Multi-party claims

13.2 Illinois Venue

All arbitration or legal proceedings shall occur exclusively in Illinois.

13.3 Attorney Fees

The prevailing party shall be entitled to recover reasonable attorney fees and legal costs.

14. Court Appearance, Subpoena & Testimony Policy

The Company and its employees are not obligated to:

  • Provide expert testimony

  • Participate in legal disputes between third parties

  • Appear in court voluntarily

  • Interpret surveillance footage

  • Maintain evidence archives

If legally compelled by subpoena:

  • Administrative fees may apply

  • Record retrieval fees may apply

  • Court appearance fees may apply

  • Hourly expert witness fees may apply

The Company does not guarantee:

  • Availability of records

  • Retention of footage

  • Preservation of evidence

15. Force Majeure

The Company shall not be liable for delays or failure to perform caused by events beyond reasonable control including:

  • Natural disasters

  • Power outages

  • Internet outages

  • Supply shortages

  • Labor disruptions

  • Government actions

  • Cyberattacks

  • Weather events

  • Transportation delays

16. Acceptance of Terms

The Client accepts these Terms and Conditions by:

  • Paying a deposit

  • Signing an estimate

  • Approving a quote

  • Paying an invoice

  • Using the website

  • Accepting delivery

  • Using Company services

  • Making online payments

Electronic acceptance constitutes legally binding agreement.

17. Governing Law

These Terms and Conditions shall be governed exclusively by the laws of the State of Illinois.

18. Modifications

The Company reserves the right to modify these Terms at any time without prior notice. Updated Terms become effective immediately upon publication on the website.
